Acceptance of Terms

By accessing or using the website at pacificaasphaltpaving.com (the "Site") or by engaging Bedrock Pacifica Asphalt Paving ("we", "us", or "our") to provide services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Site or engage our services. These terms apply to all visitors, customers, and other users of the Site.

Description of Services

Bedrock Pacifica Asphalt Paving is a Asphalt Paving Contractor based in Pacifica, CA. We provide asphalt paving, sealcoating, parking lot striping, driveway paving, asphalt repair, crack sealing, and related services to residential and commercial customers in San Mateo County and surrounding areas. Specific services, scope, materials, and pricing for each project are described in the written estimate or contract provided to the customer before work begins.

Estimates and Pricing

Written estimates provided by Bedrock Pacifica Asphalt Paving are based on the site conditions observed at the time of the visit and the scope of work described at that time. Estimates are valid for 30 days from the date of issuance unless otherwise noted in writing.

Conditions discovered during the work - such as a compromised base not visible during the estimate visit, unforeseen drainage issues, or changes requested by the customer - may result in additional costs. We will notify you in advance before performing any work that falls outside the original scope. No additional charges will be applied without your prior written or verbal authorization.

Scheduling and Cancellation

Scheduled work dates are subject to weather conditions, material availability, and crew scheduling. Asphalt and sealcoating work requires dry conditions and appropriate temperatures. We reserve the right to reschedule work if conditions would compromise the quality of the finished product. We will contact you as early as possible to arrange a new date.

If you need to cancel or reschedule a confirmed job, please give us at least 48 hours notice. Cancellations made less than 48 hours before a scheduled start may be subject to a cancellation fee if materials have been ordered or equipment has been reserved for your project. Specific cancellation terms will be noted in your written contract.

Payment Terms

Payment terms are outlined in each written estimate or contract. In general, a deposit may be required before work begins, with the remaining balance due upon completion of the project. Accepted payment methods will be specified in your contract.

Invoices not paid by the due date may be subject to a late fee as specified in the contract. Bedrock Pacifica Asphalt Paving reserves the right to suspend work on ongoing projects in the event of non-payment. Any collection costs, including reasonable attorney fees, incurred to collect overdue balances are the responsibility of the customer.

Customer Responsibilities

To allow work to proceed safely and on schedule, customers are responsible for the following before the job start date:

• Clearing vehicles, equipment, and personal property from the work area
• Notifying us of any underground utilities, irrigation lines, or other features in the work area that are not marked
• Securing pets and ensuring safe access to the property for our crew
• Arranging alternative parking for the duration of the curing period as directed by our team

Bedrock Pacifica Asphalt Paving is not responsible for damage to unmarked underground utilities, irrigation lines, or personal property left in the work area.

Warranty Disclaimer

Where a written warranty is provided in your project contract, the terms and duration of that warranty govern your rights with respect to workmanship defects. Warranty terms vary by service type and project scope.

The following conditions are not covered under any warranty we provide:

• Damage caused by tree roots, ground movement, soil settlement, or seismic activity after project completion
• Damage from heavy vehicles or equipment in excess of standard residential or commercial loads
• Surface deterioration caused by oil or chemical spills
• Damage from flooding, acts of nature, or other events outside our control
• Issues arising from customer failure to follow post-installation care instructions

Except as stated in a written project warranty, all services are provided "as is" and we disclaim all implied warranties, including warranties of merchantability or fitness for a particular purpose, to the fullest extent allowed by applicable law.

Limitation of Liability

To the fullest extent permitted by law, Bedrock Pacifica Asphalt Paving shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to the services we provide or the use of this Site. Our total liability to any customer for any claim related to a specific project shall not exceed the total amount paid by the customer for that project. This limitation applies regardless of the form of action, whether in contract, tort, or otherwise.

Site Content and Accuracy

The content on this Site is provided for general informational purposes. We make reasonable efforts to keep it accurate and up to date, but we do not warrant that all information is complete, current, or free from errors. Dispute Resolution

If a dispute arises between you and Bedrock Pacifica Asphalt Paving related to services provided or these Terms and Conditions, we encourage you to contact us first so we can attempt to resolve the matter directly.

If a resolution cannot be reached informally, disputes shall be resolved through binding arbitration conducted in San Mateo County, California, in accordance with the rules of the American Arbitration Association. You and Bedrock Pacifica Asphalt Paving each waive the right to a jury trial and the right to participate in any class action related to services or these Terms. Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought in the appropriate courts located in San Mateo County, California.

Modifications to These Terms

We may update these Terms and Conditions from time to time. When we do, we will post the revised version on this page with an updated effective date.
